Monsanto Roundup Lawsuit
At Allan Berger & Associates, we believe in holding companies responsible for manufacturing products that cause harm to the public. Our team of lawyers specialize in defective product liability and have been protecting Louisiana families for over 40 years from negligent manufacturers and product companies.
We safeguard our clients from dangerous and defective products, no matter how big the company. One such company, Monsanto, has been at the center of hundreds of lawsuits due to extensive scientific research that concluded that the key ingredient in Roundup is dangerous to those who use the product.
Our law firm is dedicated to helping clients who suffered injuries because of Monsanto’s failure to warn consumers about the potential for serious health issues from exposure to glyphosate. Consumers who have been exposed to glyphosate—the main ingredient in Roundup—are at a higher risk of developing certain serious medical conditions, including non-Hodgkin’s lymphoma. Once thought to only be dangerous in large amounts, recent research suggests that repeated exposure to glyphosate in small doses can be just as deadly, if not more so. As the number of consumers of Roundup who are diagnosed with non-Hodgkin’s lymphoma and other medical issues increases, the courts are now evaluating Monsanto’s liability and holding the company responsible for manufacturing a dangerous herbicide without warning consumers of the potential risks to their long-term health.
A recent landmark case in California did just that. DeWayne Johnson, a school groundskeeper, was awarded $289 million in damages after a jury found that his non-Hodgkin’s lymphoma and other cancers were caused by his exposure to glyphosate. During his four-year tenure, he sprayed a high-concentration version of Roundup on the school grounds up to 30 times and twice was accidentally soaked with the product. Two years into his groundskeeping position, he was diagnosed with non-Hodgkin’s lymphoma which later turned into a more aggressive form of cancer.
Last year in Louisiana, a similar case was filed against Monsanto. Chris Roberts, a Jefferson Parish Councilman, sued Monsanto for damages for being a contributing factor to his development of non-Hodgkin’s follicular lymphoma after having been exposed to glyphosate regularly since childhood. The case is still pending.
Scientific Experts Warn of the Dangers of Glyphosate
Johnson and Roberts are just two of the over 5,000 lawsuits that have been filed against Monsanto. While both Johnson and Roberts had significant exposure to glyphosate over time, recent research suggests that even minimal exposure to the chemical can be dangerous. Leading experts are cautioning the public about use of Roundup, warning that:
- Glyphosate is a probable cause of cancer in humans –The World Health Organization’s International Agency for Research on Cancer
- There is no safe level of exposure; no level of exposure of glyphosate has been found conclusively to be of no possible harm – Paul Mills, public health professor, University of California San Diego
- Known to cause cancer – California’s Office of Environmental Health Hazard Assessment
- Findings raise the possibility of health issues associated with chronic low-dose exposure to glyphosate – S. National Library of Medicine National Institutes of Health
- Exposure may affect intestinal flora, reproductive systems, and cause other health problems – Glenn Morris, Director of the Emerging Pathogens Institute
Non-Users of Roundup are Unknowingly Exposed to Glyphosate
Even consumers who don’t use Roundup themselves are at danger of exposure to the deadly chemical, especially small children and individuals with weak livers or immune deficiencies. Whether it is in the food we eat because of current agricultural practices, the water we drink because of accumulation in rural farming areas, or the air they breathe when direct spraying occurs, the average individual comes into contact with glyphosate alarmingly often. Even worse, exposure to glyphosate will continue to increase because of the rise of greater quantities of its use in farming.
Other Medical Conditions Linked to Exposure to Glyphosate
Monsanto has been lying to the American public about the effects of its product for years by falsifying scientific data. In addition to non-Hodgkin’s lymphoma, the following health conditions have been linked to exposure to glyphosate:
- Birth defects
- Autism
- Brain, breast and other cancers
- Alzheimer’s disease
- Heart disease
- Liver disease
- Diabetes
- ADHD
- Celiac disease and gluten intolerance
- Chronic kidney disease
- Depression
- Colitis
- Hypothyroidism
- Inflammatory Bowel Disease
- Lou Gehrig’s Disease (ALS)
- Multiple Sclerosis
- Pregnancy complications
- Reproductive problems
- Parkinson’s disease
- Obesity
- Respiratory illnesses
With such a wide array of possible health complications, Monsanto owed a duty to consumers to warn them about the possible side effects that could occur from the use of their product. By intentionally not disclosing this information, Monsanto breached its duty to the public and can be held legally liable for medical bills, lost wages, pain and suffering, loss of consortium, loss of quality of life, and other damages.
